1. Definitions

The term “Personal Data” refers to any information which identifies you or can be used to identify a data subject when used in conjunction with other information.

The term “Data Subject” describes the person about whom the personal data is about.

The term “PDPA” describes the Personal Data Protection Act B.E. 2562 of Thailand.

The term “Data Controller” will be regarded as Kids Sense Play.

The term “Data Protection Officer” or “DPO” refers to the assigned person in Kids Sense Play whose responsibility is to ensure that processes and procedures comply with PDPA.

The term “Process” describes how we collect, use, store or disclose personal data directly from the data subject concerned (children, parents/guardians, staff). In some cases, we collect data from third parties (e.g., referral sources, educational institutions, therapists) or from publicly available resources.
When we process any personal data (including sensitive/special categories), we do so in accordance with applicable laws and regulations (including safeguarding and employment-related requirements). Personal data held by Kids Sense Play is processed by appropriate members of staff for the purposes for which the data was provided.

The term “Parent” describes children’s parents.

The term “Guardian” describes children’s guardians.

2. Purpose of This Privacy Notice

Kids Sense Play is committed to safeguarding the privacy of children, families, staff, and all individuals who interact with our center.
This privacy notice explains how and why we collect, use, store, and disclose personal data in accordance with the PDPA.

We process personal data to support the range of services we provide. For example, Kids Sense Play uses personal data to:

  • Assess and manage applications for enrollment in our developmental programs, classes, camps, and activities.
  • Deliver learning, play-based, and developmental experiences including sensory integration, early learning support, school-readiness programs, EF skill development, and social–emotional learning.
  • Monitor each child’s developmental progress, learning needs, and goals, and communicate updates with parents or guardians.
  • Provide behavioral support and ensure children’s well-being and safety during all sessions.
  • Provide a safe and secure environment for children, parents, staff, and visitors.
  • Contact parents/guardians regarding scheduling, billing, invoices, participation, and other administrative matters.
  • Share newsletters, activity updates, announcements, and parent communications.
  • Improve the quality of Kids Sense Play programs and services.
  • Manage our operational needs, including maintaining attendance records, payment records, safeguarding reports, and administrative documentation.
  • Manage staff operations including recruitment, payroll, performance evaluation, and training.
  • Analyse website traffic and user behavior using cookies and analytic tools.
  • Promote Kids Sense Play through our website, social media platforms, publications, or other communication channels (only where consent is provided).
  • Maintain relationships with alumni families and preserve historical records of our center’s development.

Use of Photos, Videos, and Audio Recordings

Kids Sense Play regularly documents activities using photographs, video, and audio recordings (“digital media”).
Our lawful basis is consent and/or legitimate interest.

Digital media is used for:

  • Internal learning documentation
  • Progress reports for parents
  • Classroom displays
  • Recognizing children’s achievements
  • Marketing or promotional purposes (only with explicit consent)

We follow clear safeguarding protocols before sharing any child-related media.

Information System Security

Kids Sense Play employs strict technical and organizational measures to safeguard all personal data, including secure passwords, controlled access, device protections, and encrypted systems.
Third-party cloud service providers may support our digital systems under strict confidentiality obligations.

3. Scope

This data privacy notice applies to:

  • Staff, facilitators, therapists, or any individuals employed or engaged by Kids Sense Play in any capacity, including full-time, part-time, temporary, internship, contract-based, or outsourced personnel.
  • Children who are current, prospective, or former participants in Kids Sense Play programs, including play-based learning sessions, developmental activities, classes, workshops, and camps.
  • Parents or guardians who are current, prospective, or former clients of Kids Sense Play, including legal guardians responsible for a child’s enrollment or participation.
  • Third parties, including individuals or organizations, not affiliated with or employed by Kids Sense Play but who interact with our services or operations (e.g., vendors, service providers, contractors, consultants, or visitors).

Your personal data will then be processed under the privacy policies and terms of those third parties. We encourage you to review the related privacy notices of such external platforms when accessing them.

4. Policy

This data privacy policy informs you how Kids Sense Play collects, uses, stores, or discloses your personal data; the reasons for doing so; how long we retain your data; to whom we may disclose it; your rights under the PDPA; the measures we take to ensure your data remains private and secure; and how you may contact us with any questions regarding your data.

4.1. How we collect, use, or disclose your personal data

We process your personal data only where necessary and only when a lawful basis applies. This includes situations in which we collect, use, or disclose your personal data based on legal obligations, the performance of a contract with you, our legitimate interests, your consent, or other lawful grounds. The lawful bases and purposes for processing are described below.

4.1.1. Our legal obligation

Kids Sense Play is subject to laws, regulations, and oversight from relevant authorities. To fulfil our legal and regulatory requirements, it is necessary to collect, use, or disclose your personal data for purposes that include, but are not limited to:

  1. a) Compliance with the PDPA and any amendments to the law.
    b) Compliance with laws related to child protection, health and safety standards, and other regulations applicable to childcare and development centers in Thailand. This may include identity verification, necessary checks for staff or service providers, and screening against publicly available databases where required by law.
    c) Compliance with regulatory obligations and/or orders issued by competent courts, government officials, supervisory bodies, or authorized agencies.

4.1.2. Contract made by you with us

We process personal data based on your request or agreement with Kids Sense Play for the following purposes, which include but are not limited to:

  • Processing your application prior to enrollment, assessing suitability, and providing our services.
    ● Authenticating identity when entering or completing transactions.
    ● Carrying out your instructions—for example, responding to inquiries, scheduling sessions, or providing access to online learning platforms when applicable.
    ● Tracking or recording your transactions for administrative purposes.
    ● Producing invoices, receipts, and activity or payment reports as needed.
    ● Notifying you of payment due dates or changes to program schedules and services.
    ● Processing any matters relating to insurance claims or documentation, where relevant (e.g., in cases of accidents or medical incidents).

4.1.3. Our legitimate interests

We rely on our legitimate interests—balanced against your fundamental rights—to collect, use, or disclose personal data for the following purposes, which include but are not limited to:

  • Conducting Kids Sense Play operations, including audits, risk management, and the prevention or investigation of misconduct or incidents on our premises.
    ● Managing our relationship with parents and children, including support inquiries, surveys, or feedback collection.
    ● Ensuring safety and security through CCTV recordings, visitor logs, and monitoring activity within Kids Sense Play facilities.
    ● Supporting children’s wellbeing by providing necessary health-related assistance or first-aid response.
    ● Developing and improving our communication channels, programs, and services to enhance service standards and program quality.
    ● Using your personal data to better understand and fulfil your needs, including program development and internal research to improve our services.
    ● Recording images, audio, or video in relation to activities, parent meetings, staff training, program documentation, or marketing activities (subject to consent where required).

4.1.4. Your consent

Under the PDPA, rights belong to the individual (“Data Subject”). For children, Kids Sense Play relies primarily on parental or guardian consent unless the nature of the processing, the child’s age, and the level of understanding make it more appropriate to rely on the child’s own consent.

Generally, we assume consent is not required for ordinary disclosure of personal data to parents or guardians—such as sharing updates about a child’s activities, developmental progress, or wellbeing—unless Kids Sense Play determines that withholding such information is necessary for the child’s best interest or required by law.

Where appropriate, we may request your explicit consent for purposes such as:

  • Collecting, using, or disclosing sensitive personal data (e.g., health information, developmental concerns, allergies).
    ● Using personal data or digital media (photos, audio, video) for program documentation, reports, or marketing materials.
    ● Conducting research and analysis to improve our programs and services.
    ● Transferring personal data overseas to service providers with adequate data protection standards.
    ● Sharing data with trusted business partners for communication or service improvement.

Consent may be withdrawn at any time.

4.1.5. Other lawful basis

Aside from the above, Kids Sense Play may collect, use, or disclose your personal data under the following lawful grounds:

  • Preparing historical records or archives for the public interest or for research or statistical purposes (in anonymized format where applicable).
    ● Preventing or suppressing danger to a child’s or another person’s life, bodily harm, or health.
    ● Carrying out activities that are necessary for public interest or exercising official authority.

If you do not provide personal data that is required to meet legal obligations or to enter into an agreement with Kids Sense Play, we may be unable to provide or continue providing some or all of our programs or services.

5. What personal data we collect, use, or disclose

The types of personal data—including both general and sensitive personal data—collected, used, or disclosed by Kids Sense Play depend on the services, programs, or activities you participate in. The categories include, but are not limited to, the following:

Parent or guardian responses to satisfaction surveys, program evaluations, development or health questionnaires, and service preference forms.

User login and subscription data

Login details for Kids Sense Play systems or applications (if applicable); subscription data for communications or service platforms used by the center.

Information concerning security

CCTV images; video or audio recordings from sessions or within premises; visual images; visitor logs; records for safety monitoring.

Sensitive personal data (collected only with explicit consent)

Child developmental or health information; allergies; medical needs; disability or special support needs; biometric data (if ever applicable); safeguarding and incident records.

Other information

Correspondence between you and Kids Sense Play; notes from communication channels; insurance-related information (if applicable); general information provided through forms, messages, or conversations.

6. Sources of Your Personal Data

Normally, Kids Sense Play collects your personal data directly from you. However, in some cases, we may obtain personal data from other sources. In such circumstances, we ensure that the collection and use of such data complies with the PDPA. Personal data obtained from other sources may include, but is not limited to, the following:

  • Information obtained from previous schools, childcare centers, developmental clinics, healthcare providers, or other organizations with whom we have a relationship, where such information is relevant to the child’s development or enrollment process.
    ● Information obtained from persons related to you, such as family members, guardians, or individuals you authorize to act on your behalf.
    ● Information obtained from service providers or partners, such as payment processors, communication platforms, or educational technology tools used by Kids Sense Play.
    ● Information obtained from governmental or regulatory authorities, including health, safety, or childcare-related agencies as required by law.
  • Information obtained from insurance companies or related parties, in connection with insurance coverage, claims, or incident reports where applicable.
    ● Information obtained from publicly available resources, such as public databases, directories, or official records.

7. Your Rights

You may exercise your rights under the PDPA through the channels provided by Kids Sense Play in Section 14 of this Privacy Policy.

7.1 Right to access and obtain a copy

You have the right to access and obtain a copy of your personal data held by Kids Sense Play, unless we are entitled to reject your request under applicable laws, court orders, or if fulfilling such a request would adversely affect the rights and freedoms of Kids Sense Play or other individuals.

7.2 Right to rectification

You have the right to request correction of any inaccurate personal data and to update any incomplete personal data related to you.

7.3 Right to erasure

You have the right to request the deletion, destruction, or anonymisation of your personal data, unless legal grounds allow us to reject your request.

7.4 Right to restrict processing

You have the right to request that we restrict the use of your personal data under certain circumstances. For example:

  • While your request to rectify inaccurate data is being reviewed;
  • When you object to the collection, use, or disclosure of your personal data;
  • When you request restriction instead of deletion for purposes of establishing, complying with, exercising, or defending legal claims.

7.5 Right to object

You have the right to object to the collection, use, or disclosure of your personal data when it is processed based on legitimate interests, for direct marketing, or for scientific, historical, or statistical research purposes—unless we have compelling lawful grounds to reject your objection, such as:

  • Where we have overriding legitimate grounds to process your data;
  • Where processing is required for legal claims;
  • Where processing is carried out for public interest purposes.

7.6 Right to data portability

You have the right to receive your personal data in a readable, commonly used format that can be used or disclosed through automated means.
You may also request that we transfer your personal data to a third party, unless this is technically impossible or we are legally entitled to reject your request.

7.7 Right to withdraw consent

You have the right to withdraw your consent at any time, unless the nature of the consent prevents such withdrawal.
Withdrawal of consent will not affect the lawfulness of processing that occurred before the withdrawal.
You may review or change your consent for marketing or other optional purposes through the channels described in Section 14.

7.8 Right to lodge a complaint

You have the right to file a complaint with the competent authority if you believe that the collection, use, or disclosure of your personal data violates the PDPA or is conducted in a non-compliant manner.

8. How We Share Your Personal Data

We may disclose your personal data to the following parties under the provisions of the PDPA:

● Kids Sense Play business partners and individuals with whom we have a legal relationship, including our directors, management, staff, facilitators, contractors, representatives, and advisors.

● Government authorities and/or supervisory or regulatory agencies, where disclosure is required to comply with applicable laws, childcare regulations, safety standards, or official orders.

● Suppliers, agents, and other entities, such as educational tool providers, IT service vendors, external auditors, document storage providers, or cloud service operators, where the disclosure serves a specific lawful purpose and where appropriate IT security measures are in place.

● Law enforcement or legal authorities, such as police, lawyers, courts, or any persons to whom we are required or permitted by law, regulation, or official order to disclose personal data.

● Social media or digital communication providers, in a secure format, for the purpose of sharing updates, notifications, or promotional content—only where appropriate consent has been obtained.

● Third-party security service providers, such as CCTV monitoring services or access control system providers.

● Service providers who offer benefits or services to you, such as insurance companies or agents in connection with coverage or claims relating to incidents at Kids Sense Play.

● Our legal advisors, representatives, or other authorized persons, acting under valid authorization.

● Financial institutions, to facilitate payment transactions or verify related financial information.

● External health or medical providers, where necessary for responding to health, safety, or emergency-related situations involving a child.

● Safeguarding or child protection professionals, when disclosure is required to ensure child safety or welfare.

● Schools, childcare centers, or educational organizations, upon parental request for references, developmental reports, or transfer of developmental information.

● Parties necessary for the performance of a contract between you and Kids Sense Play, including service administrators or payment service providers.

● Data processors, such as educational technology platforms, communication systems, or other third parties assisting in delivering Kids Sense Play programs and support services.

● Other organizations relevant to a child’s developmental support, such as therapists, specialists, or institutions, only with parental consent where required.

9. International Transfer of Personal Data

When it is necessary for Kids Sense Play to send or transfer your personal data internationally, we will always exercise our best efforts to ensure that such data is transferred securely and only to trusted business partners, service providers, or other authorized recipients. All international transfers are conducted using the safest methods available to protect the confidentiality and integrity of your personal data. Such transfers may occur under the following circumstances:

  • To comply with our legal obligations.
  • To inform you when the destination country may have inadequate personal data protection standards and obtain your consent in accordance with the PDPA.
  • To perform an agreement between you and Kids Sense Play, or to fulfill your request prior to entering into such an agreement.
  • To comply with an agreement between us and another party when it is in your interest.
  • To prevent or suppress danger to your life, bodily harm, or health when you are unable to provide consent at that time.
  • To carry out activities necessary for the substantial public interest, in accordance with the PDPA.

10. Retention Period of Personal Data

All personal data is securely stored in accordance with PDPA requirements. Kids Sense Play retains personal data only for legitimate purposes, based on one or more lawful grounds described in this Privacy Policy, and only for as long as necessary to fulfil those purposes or as required by applicable law.

The period for which we keep your personal data is determined by the relevant statutory or regulatory requirements, including but not limited to accounting laws, tax laws, labour laws, childcare and safety regulations, and other legal obligations applicable in Thailand. In addition, we may need to retain certain records—such as CCTV footage taken within Kids Sense Play premises—to maintain safety and security, including for the investigation of incidents or suspicious activities that may be reported to us in the future.

11. Use of Cookies

We may collect and use cookies and similar technologies when you access our products and/or services. This includes when you visit our website or use any digital platforms operated by Kids Sense Play. The use of cookies and similar technologies helps us recognise you, remember your preferences, and customise how we deliver our services to you.

Cookies may be used for several purposes, such as enabling and operating essential website functions, understanding how you interact with our website or email communications, and improving your online experience as well as the effectiveness of our communications.

12. Use of Personal Data for Original Purposes

Kids Sense Play is entitled to continue collecting and using your personal data that was obtained prior to the enactment of the PDPA, in connection with the collection, use, and disclosure of such data, in accordance with the original purposes for which it was collected.
Such continued use remains subject to applicable legal requirements and is managed with the same level of care and protection outlined in this Privacy Policy.

13. Security

Kids Sense Play endeavours to ensure the security and integrity of your personal data through strict internal IT security measures and policy enforcement.
These measures include—but are not limited to—data encryption, secure storage systems, controlled access, and firewall protections.

We also require all staff members and third-party contractors to comply with our IT security standards and confidentiality policies. They must exercise due care and appropriate safeguards when accessing, using, sending, or transferring personal data to ensure ongoing protection.
